By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the service.

1. Description of Service

LocusPilot is an AI-powered website generation platform that creates static SEO optimized websites for local businesses. Our service includes:

AI-powered website content generation
Automated image generation and application
SEO optimization features (schema markup, meta tags, internal linking)
Website deployment to Cloudflare Pages
Source code delivery

2. Account Registration

2.1 Account Creation

To use our service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other security breach.

2.3 Age Requirement

You must be at least 18 years old to use our service. By using LocusPilot, you represent and warrant that you meet this age requirement.

3. Credits and Payment

3.1 Credit System

LocusPilot operates on a credit-based system with tiered pricing:

Flux Pro (Standard): 4 credits/page (first 10), then 1 credit/page
Nano Banana (Smart Visual): 5 credits/page (first 10), then 2 credits/page

3.2 70% Deposit Model

Website generation uses a deposit-based billing model:

Deposit: 70% of the estimated cost is charged when you submit a project
Settlement: After generation completes, the actual page count determines final cost
If actual cost exceeds deposit, the remaining balance is charged
If actual cost is less than deposit, the difference is refunded as credits

This model ensures you only pay for the pages actually generated, as AI estimation may differ from the final result.

3.3 Credit Purchases

Credits can be purchased through our platform. All payments are processed securely by Stripe. Credits are non-refundable except as required by law or as stated in Section 3.4.

3.4 Credit Expiration

Credits do not expire as long as your account remains active and in good standing.

3.5 Refund Policy

Due to the nature of our AI-generated content, we generally do not offer refunds for used credits. However:

If the service fails to generate a website due to a technical error on our end, we will refund the credits used for that generation
Unused credits may be refunded within 14 days of purchase if you have not initiated any website generation
Deposits for in-progress generations are non-refundable if the generation completes successfully

3.6 Pricing Changes

We reserve the right to modify our pricing at any time. Price changes will not affect credits already purchased.

4. Acceptable Use

4.1 Permitted Use

You may use LocusPilot to:

Generate websites for legitimate local businesses
Create content for businesses you own or have authorization to represent
Deploy generated websites to your own hosting or Cloudflare Pages

4.2 Prohibited Use

You may NOT use LocusPilot to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Create websites for fraudulent or deceptive purposes
Impersonate another person or business without authorization
Generate content that infringes on intellectual property rights
Create websites promoting illegal activities, hate speech, or adult content
Attempt to reverse engineer, decompile, or extract our AI models or algorithms
Resell or redistribute our service without authorization
Overload, damage, or impair our systems
Use automated scripts to access our service without permission

4.3 Content Accuracy

You are responsible for ensuring the accuracy of the business information you provide. We generate content based on your inputs and cannot verify the truthfulness of claims about your business.

5. Intellectual Property

5.1 Generated Content Ownership

Upon successful generation and payment, you receive full ownership rights to:

The generated website source code
The text content created for your website
The AI-generated images created for your project

You may use, modify, and distribute this content without restriction, subject to the limitations in Section 5.3.

5.2 Platform Ownership

We retain all rights to:

The LocusPilot platform, including its design, code, and features
Our AI models and generation algorithms
Our templates, component libraries, and generation prompts
The LocusPilot brand, logo, and trademarks

5.3 Restrictions

You may NOT:

Claim the LocusPilot platform or technology as your own
Use our brand or trademarks without permission
Resell generated websites as a competing website generation service

6. Third-Party Services

Our service integrates with third-party services including:

Cloudflare Pages: Website hosting (subject to Cloudflare's terms)
Stripe: Payment processing (subject to Stripe's terms)
Google: Business reviews and authentication (subject to Google's terms)

Your use of these third-party services is subject to their respective terms and privacy policies.

7. Service Availability

7.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or security reasons.

7.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide reasonable notice for significant changes that affect your ability to use purchased credits.

8. Disclaimers

8.1 Service Provided "As Is"

LocusPilot is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the service will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or completeness of generated content

8.2 SEO Results

While our service includes SEO optimization features, we do NOT guarantee:

Specific search engine rankings
Organic traffic levels
Business outcomes or conversions

Search engine algorithms are outside our control, and results depend on many factors beyond website quality.

8.3 AI-Generated Content

AI-generated content may occasionally contain errors, inaccuracies, or content that requires human review. This includes:

Minor typos, grammar issues, or awkward phrasing
AI-generated images with occasional artifacts (unusual proportions, distorted text)
Layout inconsistencies in rare cases

You are responsible for reviewing and editing generated content before publishing. We provide Quick Editors (Blog, Services, Images, Theme) to help you make corrections easily.

8.4 Our Support Commitment

While we do not guarantee perfection, we are committed to supporting you:

Most minor issues can be fixed using our built-in Quick Editors at no additional cost
For layout issues that cannot be fixed with Quick Editors, contact us and we will assist in resolving them using AI coding tools
Support requests should include your project name and a description of the issue

9. Limitation of Liability

To the maximum extent permitted by law, ADE Marketing Solutions Sdn Bhd and its officers, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Damages resulting from your use or inability to use the service
Damages resulting from unauthorized access to or alteration of your data

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ADE Marketing Solutions Sdn Bhd and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Content you submit or generate through our service

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us. Unused credits are non-refundable upon voluntary termination unless purchased within the last 14 days.

11.2 Termination by Us

We may suspend or terminate your account immediately if you:

Violate these Terms of Service
Engage in fraudulent or illegal activity
Fail to pay for services
Abuse our platform or support resources

11.3 Effect of Termination

Upon termination:

Your access to the platform will be revoked
Websites already deployed to Cloudflare Pages will remain live (managed by you)
We may delete your account data after a reasonable retention period

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the platform. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ADE Marketing Solutions Sdn Bhd regarding the use of LocusPilot.
